The Alternative Dispute Resolution Cell (ADRC) at NLIU, Bhopal is highly dedicated to instilling the spirit of ADR in the minds of aspiring lawyers and law students. By conducting various interactive activities, competitions, and workshops, the Cell strives to keep the student community engaged in constructive ADR activities. It was the zeal and enthusiasm of every cell member that helped ADRC sail through the turbulent times when the pandemic hit us. Instead of suffering a setback due to disruption of activities, ADRC set the ball rolling in the online mode with its creative ideas and tackled the disruption seamlessly.
ADRC’s greatest and newest venture during the COVID-19 pandemic was ‘Lex Peritia: A Knowledge Series of Webinars’. Through this series, ADRC hosted the most coveted ADR luminaries from across the globe. These esteemed personalities joined as speakers and enlightened the attendees of the webinar with their distinguished knowledge.
Lecture on Importance of Drafting Comprehensive Arbitration Clauses in International Commercial Contracts
The Alternative Dispute Resolution Cell at the National Law Institute University, Bhopal, organised a webinar as part of the Lex Peritia Knowledge Series, featuring Mr. Roberto Pirozzi. The webinar aimed to provide insights into the intricacies of drafting comprehensive arbitration clauses in international commercial contracts.
Mr. Pirozzi, an expert in domestic and international litigation, arbitration, and antitrust matters, showcased his expertise during the recent webinar. He holds memberships in the Bars of Rome and New York, and affiliations with IBA and CCIIST. Additionally, he serves as an Adjunct Professor of Negotiation and International Business Law at LUMSA and The American University of Rome.
Mr. Roberto addressed key topics during the session, discussing elements such as drafting techniques, complexities in international contracts, jurisdictional disagreements, and the importance of clarity in arbitration and mediation clauses. He emphasized the rising prominence of international arbitration over the past decades, emphasizing its advantages over litigation. Mr. Pirozzi highlighted the distinction between Ad hoc arbitration, providing flexibility but requiring cooperation, and Institutional arbitration, involving specialized institutions and established procedural rules.
Regarding the conditions for a valid International Commercial Arbitration Agreement, he underscored the importance of capacity, substantive conditions, and a written agreement. He emphasised the need for legal capacity, meeting ordinary contract requirements, and obtaining clear consent. Careful drafting was called to the centre of attention, urging the
avoidance of “pathological clauses” and outlining principles such as clarity, conflict avoidance with mandatory rules, and adherence to drafting rules. He stressed upon the absence of a one-size-fits-all standard arbitration clause, encouraging parties to consider specific circumstances when drafting. Basic elements, including a reference to arbitration, incorporation of rules, seat of arbitration, language choice, handling multiple parties, excluding appeal rights, providing for interim measures, and ensuring confidentiality, were highlighted.
Lecture on Negotiation in High Conflict Situations by Mr. Pascal Comvalius
The NLIU’s Alternative Dispute Resolution Cell recently hosted an engaging workshop on “Negotiation in High Conflict Situations” as part of the Lex Peritia Knowledge Series. Renowned mediator Mr. Pascal Comvalius, with certifications in both mediation and crisis negotiation, skillfully guided students through diverse aspects of conflict resolution.
During the workshop, Mr. Comvalius shared his expertise on mediation techniques, handling high-conflict personalities, and overcoming communication challenges. His interactive and humorous approach created a comfortable atmosphere for students. The scenarios discussed, including dealing with an active shooter, preventing self-harm, and responding to terrorist ultimatums, showcased practical applications of negotiation skills in real-life high-stakes situations.
Mr. Comvalius’s captivating personality held the audience’s attention, emphasizing the significance of trust-building through seemingly mundane gestures like self-introduction. The workshop went beyond mediation techniques, addressing strategies for navigating cross-cultural differences and establishing a baseline for behavior in intense situations. Mr. Pascal Comvalius’s demonstrated expertise shone as he navigated the complexities of high-conflict scenarios, consistently emphasizing the paramount importance of trust-building, even when faced with seemingly insurmountable challenges. The workshop proved
instrumental in equipping students with valuable insights and practical skills for negotiating in intense scenarios.
Webinar By Mr. Kevin Brown
To mark the beginning of the webinar series, ADRC welcomed mediation specialist Mr. Kevin Brown as a speaker at the inaugural session of the ‘Lex Peritia’ series. The webinar was conducted on 11th September 2020, on Zoom and witnessed overwhelming participation from the students of the university. During the webinar, Mr. Kevin discussed various aspects of ADR and delved into the intricacies involved in the process.
Mr. Kevin Brown is an eminent personality in the field of ADR. He is an Ombudsman with the United Nations Funds Programme and has been actively involved in more than 1000 mediations. One of his greatest achievements has been developing ADR training programs for a G-20 summit. The webinar conducted by him was a huge success and valuable ADR lessons learned during the session will be cherished by all students.
Webinar by Mr. Ajay Mehta
For the third webinar in the series, ADRC teamed up with a renowned personality in the field of mediation, Mr. Ajay Mehta who graced the session with his presence as a speaker. The webinar was based on the theme ‘Overview of Mediation’ and discussed various facets and nuances of Mediation as a form of Dispute Resolution. It was conducted on 21st December 2020 at 4:00 PM on the Zoom platform and received an overwhelming response and participation from the student community. The scope of Mediation as a means of dispute resolution in cases involving diverse questions of law was also discussed succinctly during the session.
Webinar by Mr. Dennis Wilson and Mr. Anuroop Omkar
The second webinar in the series had an interesting theme of ‘Beyond the Singapore Convention: Potentiality of Cross-Border Mediation’. The webinar was graced by the presence of Mr. Dennis Wilson and Mr. Anuroop Omkar who joined in as speakers to facilitate the enriching experience. It was conducted on 26th September 2020 at 4:00 PM, on the online platform Zoom.
Mr. Dennis Wilson and Mr. Anuroop Omkar have had distinguished careers in mediation and have carved a niche for themselves in this field. They elaborately dealt with various aspects of the theme for the webinar and enlightened young minds.
